He’s waiting for Gibbs by the elevator, long after Jeanne, David and even DiNozzo have left the office.
The clocks showing nearly 10 and he’s starting to get antsy when the door of director Shepherd’s office finally opens and Jethro steps out.
He moves as though everyone of his years and most of Tobias’s and Ducky’s have hit him at once, staggering rather than walking, to his desk, collecting his gun, his badge and his jacket.
I am going to kill the bitch, is Tobias’s first thought. His second is once I take care of Jethro.
He holds the elevator door as Jethro all but falls in and presses the button for the parking garage.
As soon as the elevator is moving, Tobias flicks the emergency stop button, plunging them into darkness. He doesn’t have long to wait.
“She killed him Tobias.”
He’s not surprised. He read the file. “Kinda guessed that, Jethro.” He reaches out, placing on hand on Jethro’s shoulder, and it’s enough to break the other man’s flimsy self-control.
Jethro all but falls forward, and suddenly he’s holding the taller man in his arms, as Jethro sobs against him. his fury against Director Shepherd, Vance, his own bosses, heck anyone even vaguely connected with this case, rises in his chest, but he knows it’ll do no good. Still he curses at them. Why the heck did they have to drag this up? La Grenouille was an arms dealer, a murderer many times over, did it matter who kill him?
Gently, he kisses the top of Jethro’s head. He didn’t tell him it’ll be O.K. mainly because he neither of them would believe it. Instead he just holds him, waiting until the sobbing subsides and Jethro pulls away.
He reaches down to pick up his apology for the last few days, giving Jethro a chance ot get the control he needed back.
“Emily’s at Di’s for the weekend.” He says softly. “What day a say we grab some Chinese and work on that god dammed boat of yours?”
Gibbs nods, the last verges of tears vanishing.
“Yeah.” He mutters. As Tobias switches the elevator backs to normal, he hears a muttered “Thanks Tobias.”
He shrugs, knowing acknowledging the comment will make Jethro feel worse.
The elevator doors open to reveal Kort, sporting a bloody nose. Tobias changes his mind. He won’t kill Jenny Shepherd. He’ll let the CIA do it for him.

They drove back in silence, after the interview.
Jethro waited until they were in his basement, until they’d ordered Chinese and it had arrived, before he spoke.
“Not your fault, Tobias.”
“Isn’t it?” Tobias gazed at the boat, not really seeing it. “Knew there was something screwy about that kid’s story. Told you so at the time. But I was so focused on getting Azari, I ignored the warning signs.” He shrugged. “Now three men are dead and we’ve got a turf war on our hands.”
“Kale knew what he was doing. Made his choice.”
“Was just trying to keep his men safe.”Fornell shrugged. “Never would have happened if I’d take Azari, down with Torrez.”
“Can’t change the past, Tobias.”
“True. Would have never married your ex-wife.” The bitter chuckle made Jethro put down the sander and walk over to his lover.
“Not your fault, Tobias. We both had the same evidence.” He shrugged. “You made a mistake. Got too focused. It’s not always a bad thing.” He sighed. “You’re a good man, Tobias.”
Fornell snorted. “Should have taken the shot.”
Gibbs raised an eyebrow.
“Not that kid. Del Mar.” He shook his head. “Now Dianutso and Sacks...they’ve got another one.”
“Might be better.”
“Probably be worse.”
There was simply no talking to Fornell when he was in this mood. Best thing Gibbs could do was try and distract him. With that in mind, he slipped his hand around the back of Fornell’s head, pulling him in close. Slowly, almost tenderly, he kissed him, fighting the desire to smile a little as Tobias relaxed into him.
“We fought,” He muttered, tackling Fornell’s shirt, “So that the kids don’t know the worse.” He shrugged, as Fornell’s hands slipped under his own. “Maybe they fight so that Emily doesn’t.”
Fornell smiled. “Suggested she might want to consider a career in FBI. Told me she’s going to be a,” He shuddered slightly. “A Lawyer.”
“Blame Di for that.”
“Blame you for introducing us.” There was no real anger or bitterness in the statement, but a desperate need for reassurance as Fornell’s eyes met his.
“We screwed up today, didn’t we?”
Gibbs shrugged. “We’ll get him.”
“You seem very sure about that.”
“Got Naps, didn’t we?”
“Yeah. Forgive me if I hope we don’t have to use the same tactics, my necks never recovered.”
“Looks fine to me.” Gibbs confirmed that remark by moving his attention down, kissing and lightly nipping at Fornell’s neck. The other man rolled his eyes.
“Yes, you “checked it” for damage quite thoroughly afterwards.”
“Don’t remember you complaining.”
“No.” He paused, smiling up at the taller man. “It’s being hurting a bit today though.”
“Oh.” Gibbs was smiling, in the way that promised fun, even when he was being a superior bastard. “Maybe I’d better check it again.”
Fornell sighed, feeling strangely relaxed.
They’d got Azari, even if it wasn’t in the way he wanted, and NCIS and FBI lawyers meant it was fairly unlikely Kale would get life. He was here with the man he loved. They’d get Del Mar another day.
“Think you’d had better.”
